This morning session will examine the defenses and strategies available to lawyers representing consumers sued in state court for credit card and similar debts by creditors and debt buyers, with a focus on debt buyers’ practices. It will examine flaws in pleadings, affidavits and business records used by collection law firms in these types of cases. It will survey consumer defenses that may be available in these suits.  Much of the presentation will be organized as a mock state trial court proceeding involving a suit against a consumer by a debt buyer.
